What You Need to Know About Filing for Social Security Disability Insurance:
While Social Security disability insurance is a right, there is a specific set of criteria that you must meet to be eligible. Those include:
- That you can no longer work because of a mental or physical impairment that has lasted or is expected to last continuously for a 12-month period.
- That your condition is in the list of severe impairments.
- That your condition has made it impossible do the work that you had done for over the past 15 years, or;
- That your impairment prevents you from doing any other type of work based on your age, work experience, education or skills.
If you meet those criteria, it is to your benefit to seek help from a lawyer with experience in filing initial Social Security disability insurance claims, and who can help you by securing documentation and completing the necessary forms.
Why Was My Claim Denied?
Most initial SSDI claims are denied. The most common reasons (assuming you met the criteria as spelled out above) are that the initial form was filled out incorrectly, or that the information was incomplete. Navigating the labyrinth of regulations, learning the language, and compiling and filing all the requisite documentation can be an overwhelming task. At our law firm, we have helped many people get their claims reconsidered and successfully appealed.
